Purpose
The General Terms and Conditions of Sale (hereinafter “GTC”) apply to all orders for services and products placed between the Client (hereinafter “the Client”) and Chirurgie-avant-apres.fr, represented by:
Any purchase on the website implies full acceptance of these Terms and Conditions.
Recessed-chin.com offers simulations (digital photo retouching) of cosmetic and reconstructive surgery.
Prices
The sales prices are those applicable at the time of purchase. Recessed-chin.com reserves the right to modify its prices and services at any time, without notice or compensation. Payment is made when ordering the simulation on the website, by credit card or bank transfer when this payment method is offered.
Refunds
Once purchased, the services sold on the Recessed-chin.com website are non-refundable, including in cases of force majeure, cancellation of the operation, or if the buyer is not satisfied with the result.
Right of Withdrawal
Ordering a simulation on the Recessed-chin.com website results in immediate execution of the order. In accordance with Article 121-20-2 of the French Consumer Code, the right of withdrawal cannot be exercised for these services, which are considered to be clearly personalized. In the event of partial fulfillment, a partial refund may be issued if the request for the right of withdrawal is made within the legal deadlines. 5. Order A simulation can be ordered directly on the Recessed-chin.com website.
Deadlines
Once the order is submitted, the simulation/photo editing will be completed within 24 hours (business days: Monday to Friday). In the event that these deadlines are extended (Christmas holidays, summer vacations, force majeure, etc.), the customer will be notified that their order cannot be fulfilled within 24 hours. They may then decide: – to postpone their order according to the deadlines offered by Recessed-chin.com. – to cancel their order and request a refund.
Sending the Simulation
Once completed, the simulation will be sent by email to the address indicated on the order form. It is the Customer’s responsibility to save and retain the digital files provided by Recessed-chin.com. Recessed-chin.com declines all responsibility for loss or damage to the digital files provided to the Customer and will charge for any duplicate requests.
Impossibility of the Simulation
In the event that a simulation cannot be performed, we distinguish between two cases:
– The photo provided by the customer does not meet the recommendations: the customer is informed that the simulation could not be performed. The customer will have to send a new photo. If they do not have another photo to provide, they will not be able to request a refund of their credit.
– The photo provided by the customer meets the recommendations, but Recessed-chin.com is unable to complete the request. The customer will have the choice between sending a new photo or requesting a refund. Recessed-chin.com reserves the right to partially or completely refuse any request, without providing a reason. In this case, Recessed-chin.com will refund the order (partial or complete) that could not be fulfilled.
Recommendations for photos sent by customers
When the customer requests a simulation, they must adhere to the following guidelines:
– Clear photo – Front or profile photo (depending on the planned surgery). No 3/4 photos, head turned photos, photos taken from above or below, etc.
– Good lighting. The face (or any other part of the body affected by the surgery) must be well lit (from all sides), with shadows present but light.
– White/beige/light and plain background. Ideally, the person photographed should be 50cm to 1m from a white wall.
– The photo must be well framed, with the area to be operated on clearly visible.
– Hair tied back. Specifically, for ear pinning simulations, long hair must be tied back so as not to show behind the ears.
– The face must be neutral, expressionless. Exception: for gummy smile surgeries, the photo must be taken from the front with a natural smile. If in doubt, please send us your photo, specifying the desired procedure, and we will let you know if it is feasible or not.
Image Rights
By placing an order on Recessed-chin.com, the customer certifies that they hold all image rights to the photo provided for the simulation.
If the customer places the order on behalf of a third party (e.g., a surgeon placing the order on behalf of a patient), the customer certifies that they hold all image rights to this photo (written and signed agreement). If a surgeon, clinic, or hospital wishes to publicly display the image provided by Recessed-chin.com, they must ensure they have the consent of the person appearing in the photo. We decline all liability in the event of a customer’s violation of image rights. The client (patient, surgeon, clinic, etc., who holds the rights to the image) may use the simulation image as they see fit, in a private or public setting, commercial or otherwise, in print or digital format, provided they first ensure that they own the image rights of the person appearing in the original photo. If a patient signs a document authorizing the use of their photo for the benefit of a surgeon, clinic, hospital, etc., this document must also include a specific agreement to use the simulation created by Recessed-chin.com.
The simulation must not be used for false advertising, forgery, or any other purpose intended to mislead the viewer. We recommend indicating “illustrative image” below the image.
The client is prohibited from modifying the simulations without prior authorization from Recessed-chin.com.
Duty of Prevention of Surgeons, Clinics, and Hospitals
Surgeons, clinics, and hospitals that provide simulations to their patients must warn them that the simulation is intended solely to demonstrate the desired outcome and not to guarantee a guaranteed result.
Patient Prevention
Before/after simulations are intended to provide you with a visual to show your surgeon so you can best explain what you would like to achieve with the surgery. Performing a before/after photo simulation does not mean that a surgical procedure will achieve the same result. Indeed, it is a photo retouching performed with surgical morphing software and in no way predicts the technical feasibility of performing the surgery. Therefore, only your surgeon can confirm the feasibility of the surgery (rhinoplasty, genioplasty, ear pinning, etc.). Indeed, digital simulation cannot predict the outcome of the surgery.
Simulation images do not constitute an obligation of results for your surgeon. Indeed, before/after images have no contractual value and should not influence your decision to undergo surgery. Therefore, you cannot hold the surgeon or recessed-chin.com responsible for any discrepancy between the simulation image and the post-operative result.
All surgery presents risks, so we strongly advise you to respect the reflection period recommended by your surgeon. We also draw the attention of younger people to the dangers of “fads” and the advice given by influencers on Instagram or TikTok.
In summary, we advise you to take the time to consider your cosmetic or reconstructive surgery plan. A simulation can help demonstrate to your surgeon what you would like to achieve but should not be considered a result that will be achieved through surgery.
Retouching a Simulation
The client may request that a simulation be retouched or modified. Each retouch will be billed at 50% of the price of the initial simulation. For example, for a simulation that would have cost €30, the adjustment(s) made to this simulation will be charged €15 per adjustment. Recessed-chin.com may refuse the adjustment request if we consider it irrelevant or impossible to carry out.
Law and Jurisdiction
The contract is subject to French law. In the event of a dispute, the parties will attempt to resolve the disagreement amicably. In the absence of an amicable agreement, express jurisdiction is assigned to the Commercial Court of Lyon or the Judicial Court of Lyon.
